    Rome was a Republic. Democracy - not so much.
    Res Publica - the things of the people. But it doesn't say who is in charge of them.

    Yes, his general rule of thumb, EXCEPT when he wanted to decide cases his way. Then his preferred (at the moment) constitutional provision destroyed any attempt at representative government. E.g., Citizens United, the 2nd amendment cases, the Obamacare cases, etc etc.

    ETA: Oh, and that classic, Bush v. Gore, when the Supreme Court majority threw the presidency to G. W. Bush, based on a bogus equal protection ruling, rather than allowing the constitutional political process to work as it was designed.
